Chatbu User Agreement and Terms of Service

This User Agreement ("Agreement") constitutes a legally binding agreement between you ("User", "you") and DATALONGA SOLUTIONS LTD, trading as Chatbu (Company No. 16372088, United Kingdom) ("Company", "we") governing your use of the Chatbu platform ("Service", "Platform"). By registering for or using the Service, you agree to all terms of this Agreement.

1. Service Description

Chatbu is a cloud-based platform that enables users to create, configure, and integrate AI-powered chatbots into their websites. Our services include chatbot creation, document uploading and processing, chat history analysis and reporting, and third-party integrations.

2. Data Collection and Processing

2.1 Data Collected

We collect the following data during your use of the Service:

Account Information: Name, email address, phone number, and your password (stored in encrypted form).
Content Data: Documents, files, and other content you upload for your chatbots.
Usage Data: Chat histories, chatbot interactions, and platform usage statistics.
Technical Data: IP address, browser information, and session data.

2.2 Purposes of Data Processing

Your data is processed for the following purposes:

To provide, maintain, and improve our services
To train AI models and optimize chatbot responses
To detect and resolve technical issues
To fulfill legal obligations

3. Third-Party Services and Data Storage

Your data may be stored on third-party servers and cloud infrastructures to enhance service quality and ensure the operation of our platform. This includes:

AI Providers: Your uploaded content and chat data may be transmitted to third-party AI providers such as OpenAI, DeepSeek, or similar services to generate AI responses. These providers operate under their own privacy policies.
Cloud Infrastructure: Your data may be stored on servers provided by Amazon Web Services (AWS), Google Cloud Platform, or similar cloud providers.
Vector Databases: Your content may be stored in vectorized form in third-party databases to enhance your chatbots' performance.
Payment Processors: Your payment information may be processed by Stripe or similar payment processors for secure transactions.

These third-party services are governed by their own privacy policies and terms of service. Chatbu does not have full control over the data processing practices of third-party providers and cannot be held directly responsible for data breaches caused by the actions of these providers.

4. User Content and Liability

4.1 User Responsibility

You are solely responsible for all content shared, uploaded, or processed through the Platform ("User Content"). This means:

You must ensure you have legal rights to all documents and content you upload.
You are responsible for the accuracy and appropriateness of responses delivered to end users through your chatbots.
If you upload documents containing personal data, you must have obtained necessary consent from the individuals whose data is included.
You may not use the Platform to create content that is unlawful, misleading, harmful, or that violates the rights of others.

4.2 Limitation of Liability

Chatbu is not responsible for any content uploaded to the platform by users, shared through the platform, or delivered to end users through chatbots. AI-generated responses are for informational purposes only and do not constitute professional advice. Chatbu:

Does not guarantee the accuracy, completeness, or reliability of AI responses.
Cannot be held liable for any direct, indirect, incidental, or consequential damages arising from User Content.
Is not responsible for damages caused by users to third parties.
Cannot be held liable for damages arising from service interruptions, data loss, or technical failures.

5. Intellectual Property

You retain intellectual property rights to the content you upload. However, by uploading content to Chatbu, you grant us a limited, non-exclusive license to process, store, and use your content as necessary to provide the services. This license is limited solely to uses necessary for the operation of the Service.

6. Privacy and Data Security

We implement industry-standard security measures to protect your data. These measures include:

SSL/TLS encryption for data transmission
Passwords hashed using bcrypt
Access control and authorization mechanisms
Regular security audits

However, you acknowledge that no method of data transmission over the internet or method of electronic storage is 100% secure. While we implement reasonable commercial security measures, we cannot guarantee absolute security.

7. Account Security

You are responsible for the security of your account and all account activity. You must keep your password confidential and promptly notify us of any unauthorized use of your account.

8. Service Modifications and Termination

Chatbu reserves the right to modify the terms of service with prior notice.
You may delete your account at any time. After account deletion, your data will be removed from our systems within a reasonable timeframe.
Chatbu reserves the right to suspend or terminate your account in the event of a breach of this Agreement.

9. Age Restriction

You must be at least 18 years old to use Chatbu services. If you are under 18, you may not use this service.

10. Governing Law

This Agreement is governed by the laws of England and Wales, and any disputes arising from or related to this Agreement are subject to the exclusive jurisdiction of the courts of England and Wales.

By registering, you confirm that you have read, understood, and agree to all terms stated above. You acknowledge that your data will be stored and processed on third-party servers, and that you are solely responsible for the content you share through the platform.
